Haven't heard much about the IceTv vs Nine case lately. In case you didn't now, the previous court decision has been overruled and has been referred back to the court for a review.

Justice Bennett will be handing down her judgment today regarding the second round of this legal battle (Nine's Appeal). Following a meeting with our legal team shortly afterwards , we will make a formal statement via our website as soon as possible.
Unfortunately at this point in time we are unable to make any comment or discuss the likely outcome publicly.

As most of you know, we have already seeked to have the matter heard in front of the High Court despite what may be decided by the Courts today. We will continue to fight for the right for an independant third party EPG provider (like IceTV), to remain available to Australian consumers as is the case in many other countries around the world.

Matt, I've seen your announcement on the IceTV news page and noticed a lack of Nine guide data, when can you tell us what Justice Bennett ruled? Obviously it favoured Nine at this point.
I know that IceTV will vigorously deny this, but I think this is the beginning of the end. Unless the government gets involved to mandate access to the data, 7 will jump on the bandwagon (probably 10 too) & then you've got a near worthless service.
You can't operate under an injunction forever - and it's going to put potential subscribers off, meaning less cash to fund the high court challenge.
This will be a huge boost to Tivo.

With the next version of Media Centre supporting EIT data for the guide, this decision could be the end.
Personally, I hope they get leave to apply to the High Court, and I hope to hell they either win or Stephen Conroy actually does something for consumers and tells the Broadcasters they must licence their data at a reasonable cost.

I hope not, it would be an ugly precedent for the gov. to force a business to run its business according to the dictates of a government. I though that was how dictatorships start.
I'd rather see the TV networks "persuaded" to make the guide data available on their own, For example, do they really need so much FREE publicly owned bandwidth just to show duplicate channels vs. maybe they do to broadcast the full EIT data, that way the choice is theirs as in loose the bandwidth or justify it with full EIT data, see no one would be forcing them to broadcast the data.

Telstra are already regulated like this.... and thank god for that, otherwise we would be screwed.
Anyway, Oz made the point in the other thread. We own the airwaves, they just licence it. In any event all but one channel provides 7 days data over EIT... it's just crap data.
